Business Valuation in Divorce

When one or both parties owns a business, or professional practice, such as a doctor, lawyer or accountant, the risk of expensive ongoing litigation is greatly increased.

In dissolution of marriage proceedings, business assets must be analyzed to first determine their character, i.e., is the asset community property, or the separate property, in whole, or in part, of one spouse. Business valuation usually involves the use of expert witnesses, most commonly a certified public accountant who is also a certified valuation analyst.

If your dissolution of marriage case involves a business, it is important to select an attorney with knowledge and experience in the area of business valuation. Your attorney should be familiar with qualified expert witnesses who are able to assist in preparing your case, both in determining the value of the business and in many cases, determining income from the business for child and spousal support purposes.

As an experienced qualified certified family law specialist who understands the issues related to business assets, I can help you try to avoid protracted expensive litigation and, if necessary, know how to present your case properly to the court in an effort to obtain a favorable outcome.

" Mark took my case, which was a tough one, to litigate a contentious child custody trial--which ended up going for 17 courtroom days! I had another family lawyer prior to trial, but I felt I needed an attorney with Mark's experience, smarts, and toughness for the courtroom. Mark was fantastic"
